Albuquerque New Mexico Truck Accident Lawyers

Who we are

Ask any Albuquerque truck accident victim about their experience and they will tell you how different it is from any other type of accident. They will tell you about the horrifying realization of knowing you are about to be involved in a trucking accident. That there is a feeling of hopelessness moments before impact.

But they also discuss the feelings of hopelessness that follow after the accident; navigating insurance claims, deciding who should pay the medical bills, what to do about lost wages, juggling legal issue while knowing are likely up against a multi-state corporation.

Trucking accidents are fast, powerful, and often times devastating actions that take only seconds to occur, but leave a lifetime of injuries. Just like commercial truck accident wreckage could be vast and overwhelming, so too can the pursuit of the cases they leave behind. The paperwork is often intense and the demand for an attorney with specialized knowledge in the field is essential.

It is that exact understanding about commercial truck accidents and the penetrating effect they can have into the victim’s life that makes the Fine Law Firm so passionate about the type of work they do. Above everything else, our New Mexico truck accident lawyers still believe in old fashioned ideas like: the lawyer works for the client, client’s questions should be answered quickly and competently, that it should not require an act of congress for a lawyer to return a call, and that we truly are personal attorneys and counselors at law.

[1] Do the attorneys have a history of winning cases like mine?
[2] Do I trust the attorneys to act in my best interest rather than their own?
[3] How do the attorneys' fees compare with others?
Frequently asked questions

What Does an Albuquerque Truck Accident Lawyer Do?

A personal injury claim may appear to be very straightforward at first, but countless factors may complicate a case. With commercial trucking accident injury claims, it is common for large trucking companies with vast resources to launch their own investigations into personal injury claims from other drivers. They will look for any reason to shift blame to the claimant and away from their company and employees. A truck accident lawyer helps an injured driver with a truck accident claim in several important ways.

A personal injury attorney can help his or her client secure trucking company maintenance records, driver log books, traffic camera footage, and dash cam footage from other drivers to help build a strong case for the plaintiff. The plaintiff’s attorney can also consult with relevant expert witnesses such as safety experts, engineers, medical practitioners, and other professionals who can support a plaintiff’s claim with impartial, objective professional analysis. Albuquerque truck accident lawyers can also manage communications with insurance companies and assist a client with personal finances for the duration of a case.

Why Are Truck Accidents Different From Other Vehicle Accidents?

Truck accidents are much more damaging and deadlier than other vehicle collisions because a fully loaded tractor-trailer is exponentially larger and heavier than the average passenger vehicle. An 80,000-pound loaded truck cannot maneuver, accelerate, or slow down as quickly or gracefully as smaller, lighter vehicles. When trucking accidents occur, they often involve multiple vehicles, serious injuries, wrongful deaths, and extraordinary amounts of property damage.

Truck accident claims also differ from typical vehicle accident claims due to the federal laws surrounding the trucking industry. Trucking companies must consistently meet rigorous compliance requirements while still meeting delivery schedules and addressing customer concerns. Unfortunately, this encourages some trucking companies and truck drivers to cut corners and increase the risk of accidents. Trucking companies generally also maintain a tremendous amount of insurance coverage. Navigating the complex coverage issues that often arise from truck accident claims is very different than managing a typical private insurance claim for a car accident.

How Much Does a New Mexico Truck Accident Attorney Charge?

The cost of legal fees unfortunately deters many claimants from securing representation. The lawyers at The Fine Law Firm operate on a contingency-fee basis. That means you won’t pay anything unless we secure a monetary award on your behalf. We won’t charge you for our time, effort, or resources if your case doesn’t win a settlement. If we win a settlement or verdict, we’ll deduct our attorney’s fees directly from the amount we obtain from the defendant or insurance company. That way, you never pay for our services out of your own pocket.

The Fine Law Firm keeps its fees at a flat rate of 33% (one-third) of your settlement. If you received a $100,000 settlement, for example, our fees would total around $33,000. We will reduce our fees, if necessary to receive less compensation than our client does. Our goal is to help our clients, not to turn a profit. A lawyer representing your case will garner better results – even after subtracting the attorney’s fees – than you could on your own.

At the Fine Law Firm, we are proud to utilize our four decades of knowledge in New Mexico accidents to help you receive the maximum possible compensation for your needs.

Major Shipping Routes in New Mexico

Two major interstate highways intersect in Albuquerque, New Mexico near the center of the state. Interstate 25 runs from the northeast from Raton through Albuquerque and south to Las Cruces. Interstate 40 bisects the state west to east through Albuquerque from Gallup in the west to the Tucumcari and Logan area in the east. These are two of the most heavily traveled interstate routes in New Mexico and major shipping routes for tractor-trailers.

Types of Truck Accidents

Truck accidents occur in a variety of ways, and each of them can cause devastating injuries and extreme property damage.

  • Rollover accidents occur when a force causes a tractor-trailer to roll over on its side and tumble into adjacent lanes of traffic.
  • A jackknife accident can happen for a variety of reasons and potentially injure drivers across multiple lanes. Jackknifing describes a truck’s trailer swinging out to one side while continuing to travel forward, creating an L shape.
  • Tip-over accidents are common with trucks carrying empty trailers in areas with high winds or sharp curves. Since trucks have higher centers of gravity than smaller vehicles, carrying an empty trailer can easily lead to a tip-over.
  • Rear-end collisions are one of the most common kinds of vehicle accidents. Large trucks cannot stop as easily as smaller vehicles, so if a vehicle suddenly brakes in front of a tractor-trailer the driver may not be able to stop in time to avoid a rear-end collision. These are devastating accidents regardless of whether the other vehicle is in front of or behind the truck; a truck rear-ending another vehicle can cause extreme damage, and a smaller vehicle that hits a truck from behind could become stuck under the body of the trailer.
  • Turning accidents are another common type of trucking accident and occur mostly due to blind spots. Due to the size of most tractor-trailers, drivers must contend with blind spots and may not notice a smaller vehicle in an adjacent lane as the truck begins to turn. Most trucks also require extra turning space to complete sharp-angle turns.

Common Causes of Truck Accidents

Many possible scenarios can lead to trucking accidents. A truck driver who uses drugs or alcohol to cope with stressful driving and tight deadlines could cause a DUI accident. In 2017, 5% of truck drivers tested in fatal crashes showed positive results for at least one drug. A fatigued driver could fall asleep at the wheel, or the trucking company could have failed to perform necessary maintenance that leads to an equipment failure on the road. Damaged road surfaces, debris, and wildlife can lead to truck accidents in New Mexico. It is also possible for a third party to cause a truck accident that injures other drivers. For instance, 81% of car-truck accidents were the fault of the driver of the car, according to a study by The University of Michigan Transportation Research Institute.

Determining liability for a truck accident can be a challenge, and the right attorney can make a difference in the outcome of a New Mexico truck accident case. An attorney can help a client recover medical expenses, lost income, property damage, and pain and suffering compensation from a successful claim.

Recognized Nationally & Respected Locally

They were always so patient and so considerate in helping us get through a situation that isn't very common.
They were totally accessible and extremely professional. They took the time to explain everything and answered every question I asked. They walked us through everything and made a horrible situation as best as it could possibly be. They just seemed extremely competent and knew exactly what to do at every turn.
S.M.
My experience working with the firm was probably as pleasant as a legal experience can be.
They handled things with care and were sensitive to the nature of the incident. We were involved in a dog attack where two dogs attacked my son and I got in between them. We were both hospitalized for several weeks and my son almost passed away. We have health insurance, but when you have such extreme trauma the insurance company doesn't cover everything. We had medical bills and a big financial burden.
Anonymous
I could not say enough kind words to convey how professional and caring during a very difficult time in my life.
Every visit to the office I was made to feel like I was the only client. They explained everything completely. I was introduced to every member of the Fine Law Firm. They went out of their way to resolve my case. If I ever need legal help again, I would not hesitate to call the Fine Law Firm.
